Terms of Service

By using Memento Vivere (the "Service"), you agree to these Terms of Service. If you do not agree, you may not use the Service.

1. The Service

Memento Vivere is an application that lets you keep memories, documents and instructions in encrypted form, to be delivered to designated beneficiaries after a prolonged absence of periodic check-ins by the account holder. The detailed workings of the service, liability limitations and security architecture are described on the Disclaimer page, which forms an integral part of these Terms.

2. Accounts

To use the Service you must be at least 18 years old and provide a valid email address. You are solely responsible for the confidentiality of your login password and master password, and for all activity carried out through your account. You agree to provide accurate information and keep it up to date.

3. Plans and payments

The Service offers a free plan and a paid Premium plan, with the features described on the Pricing page. Purchases, renewals and refunds relating to the Premium plan are handled by Paddle.com Market Ltd as an authorized reseller (merchant of record) and are subject to Paddle's Terms of Use for consumers, which apply in addition to these Terms for anything payment-related.

4. Cancellation and account deletion

You can delete your account at any time from the app's settings. Deletion is permanent and irreversible: it permanently removes your profile, your rooms and all associated content. If you have an active Premium subscription, deleting your account does not automatically generate a refund — for withdrawal from purchases, refer to Paddle's terms.

5. Limitation of liability

The Service is provided "as is". To the extent permitted by applicable law, Dia Amadores S.R.L. is not liable for indirect damages, data loss resulting from the user's own loss of credentials (see the Disclaimer for details on the Zero-Knowledge architecture), or service interruptions caused by circumstances beyond our reasonable control. Nothing in these Terms limits any mandatory rights you may have as a consumer under the law of your country of residence, where applicable.

6. Changes to these Terms

We may update these Terms from time to time. In case of material changes, we will notify you through the app or by email before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

7. Governing law

These Terms are governed by Romanian law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Iași, Romania, without prejudice to any mandatory rights you may have as a consumer resident in another EU member state.
